The Supreme Court officially rejected to block the Texas law which directed abortion ban after 6 weeks of pregnancy. The Texas abortion ban is being termed as the “most restrictive reproductive rights legislation” ever been placed!
The law which is officially known as the “Texas heartbeat act” indicated that abortion will be ban across the southern state once the fetal heartbeat is there. This is to be enacted all over the state regardless of the circumstances.
There are no exceptions granted to incest or rape cases. The law also states that people who help women getting abortions must be reported to the authorities including the car-taxi services such as Uber, who usually take the women or help them getting unwanted pregnancies aborted.
The law makes only one exception and that is if the health of the woman in question is in danger.
Texas is not the first state to pass such obscure law in today’s progressive time. Many Republican-led states have passed similar laws but they all have been stopped by the respective courts of the states.
Abortion was legalized in the United States of America in 1973.
This new Texas law is up till now the most dramatic restriction in terms of freedom of decision making especially the abortion rights across the country.
The supreme court stated “in reaching this conclusion. We stress that we do not purport to resolve definitively any jurisdictional or substantive claim in the applicants’ lawsuit. In particular, this order is not based on any conclusion about the constitutionality of Texas’ law, and in no way limits other procedurally proper challenges to Texas law, including in Texas state courts.”
The law was refused by a bench of 5-4. The five justices of the supreme court which backed the law were Justice Stephen Breyer, Chief Justice John Roberts, Justice Elena Kagan, and Justice Sonia Sotomayor.
Justice Sonia Sotomayor, who is openly a liberal justice, was shocked with the decision calling it “stunning” as “her colleagues have opted to bury their heads in the sand over a flagrantly unconstitutional law engineered to prohibit women from exercising their constitutional rights.”
Former first lady Hillary Clinton called out the supreme court stating “it is doing nothing and letting the unconstitutional abortion ban go into effect.”
The decision was condemned from all corners of life across America.
Alexandria Ocasio-Cortez tweeted “Republicans promised to overturn Roe v Wade, and they have. Democrats can either abolish the filibuster and expand the court, or do nothing as millions of people’s bodies, rights, and lives are sacrificed for far-right minority rule. This shouldn’t be a difficult decision.”
President Joe Biden showcased his disappointment over the supreme court’s ruling stating that “he will fight for women’s constitutional rights enshrined under Roe v Wade. The Texas law significantly imposes women’s access to the health care they need, particularly for communities of color and individuals with low incomes.”
The law specially bans abortion after the heartbeat detection – which makes more or less 6 weeks. Most of the time, women get to know about being pregnant around this time frame. The supreme court’s ruling has started a new debate across the country which will only get heated as time passes by.
